SocialNow.io Service Agreement
This Service Agreement (“Agreement”) outlines the terms and conditions for services provided by Social Now.io (“SocialNow.io,” “We,” or “Us”) to the client (“Client” or “You”). This Agreement is legally binding and governs the relationship between the Client and SocialNow.io. By engaging SocialNow.io’s services, the Client agrees to abide by the terms and conditions outlined herein. The effective date of this Agreement is the date of service engagement by the Client.
1. Services
SocialNow.io offers a range of services as described on our website (www.SocialNow.io) (“Services”). By accepting these terms, you acknowledge that you have reviewed and understood the specifics of the Services provided. It is your responsibility to read and comprehend these terms to ensure complete understanding of the services.
1.1. Due to the nature of working with third-party platforms like Facebook, Instagram, Twitter, and LinkedIn, certain issues, such as disconnections or password changes, may occur beyond our control. SocialNow.io cannot initiate services (content curation and posting) until at least one platform has been connected to our dashboard. Once connected, SocialNow.io will commence posting to your accounts based on the agreed start date or the upcoming new month. Any password changes must be reported to SocialNow.io immediately to avoid service interruptions. Regularly reviewing your accounts and providing feedback is also essential. In the event of disconnections or account access issues beyond our control, the Client agrees not to hold SocialNow.io liable. As long as access to one platform is maintained, and postings are in line with the agreed schedule, SocialNow.io is fulfilling its service as described. Missed posts due to account lockouts not attributed to SocialNow.io are not eligible for refunds or credits. For cancellation and refund policies, please continue reading.
2. SocialNow.io Obligations
2.1. SocialNow.io will provide Services to the Client following SocialNow.io’s standard policies and procedures. SocialNow.io reserves the right to reject clients at its discretion. SocialNow.io is responsible for all aspects of delivering the Services.
2.2. All rules, policies, and operating procedures concerning privacy, pricing, customer service, and other aspects of the Services will apply, subject to change at SocialNow.io’s sole discretion. This includes pricing, package inclusions, and more. If we continue to offer an archived product, you may be grandfathered into it at SocialNow.io’s discretion.
3. Service Descriptions, Fees, and Payment
3.1. All fees for Services provided to the Client are due and payable in advance of service provision. A valid credit card must be securely on file for monthly payment of fees. The Client authorizes SocialNow.io to charge their credit card for the specified fees.
3.2. Initial charges for Services will be paid in advance. The Client agrees to the setup fee specified on the website when signing up. Subsequently, SocialNow.io will attempt to charge the Client’s credit card on the monthly anniversary of their initial order. The Client agrees to pay the monthly management rate until the agreement is canceled or modified. Non-payment by the due date will result in the suspension of Services until full payment is received. Service suspension due to non-payment will not result in fee proration. If SocialNow.io cancels due to non-payment, the Client will be notified via email. Setup fees are non-refundable if any are collected.
3.3. Except in the case of a material breach of this Agreement by SocialNow.io, SocialNow.io does not issue refunds of fees for any reason. Fees owed to SocialNow.io are not contingent upon any form of marketing results. The Client is paying for the time and work performed. SocialNow.io may provide credits for verifiable mistakes on its part.
3.4. Cancellation Policy - Cancellations require at least 30 days’ notice before the Client’s next billing date by submitting an email to info@socialnow.io. Cancellation is not permitted before the second billing. After the second billing, the Client has the right to cancel this Agreement with 30 days’ notice. Cancellations must be processed and confirmed by our billing department. Cancellation requests sent to employees outside of the billing department are not guaranteed. Prorated refunds are not issued for cancellations received early in a billing period, but work may be completed through the remainder of the month(s), subject to any adjustments in fees or services. Clients who receive paid advertising/lead gen services commit to a minimum of 90 days, with no refunds.
3.5. Work continuation for a Client with a past due balance who did not cancel will result in accrued back payments. SocialNow.io does not charge interest. Accurate records of all communication and work performed will be maintained to justify any back payments due.
3.6. Our Services officially commence the day You sign up and We begin the onboarding process, not when We first post. If onboarding takes longer than 4 business days due to SocialNow.io’s delay or the Client’s delay in providing necessary materials, the billing date will be adjusted to ensure the Client receives a full month of service once onboarding is complete with at least one profile.
3.7. This Agreement supersedes and replaces all prior agreements between the parties relating to the same subject matter. Any agreements, directions, or claims made by SocialNow.io employees will be overridden by this Agreement unless a formal variance is confirmed and agreed upon by the Client and SocialNow.io’s executive-level management.
3.8. Posting to Multiple Platforms and Missed Posts – Many of our packages include posting to multiple platforms through a cloud platform technology. Social media account disconnections for various reasons beyond our control are common in social media marketing practices. Pricing is based on posts going out on a minimum of one channel, with additional platforms considered as free additions. Clients are requested to check their social media accounts at least twice a week to review content and provide feedback, as well as report any potential disconnects for prompt reconnection. If SocialNow.io is posting to at least one social media channel, it is fulfilling its contractual obligation as outlined in this Agreement. In the event of missed posts on any profiles, SocialNow.io agrees to post all created content once access is regained. No refunds are provided in the event of additional profiles not receiving posts for any period of time.
3.9. Quality of Posting – Social media content is highly personalized, and individual preferences vary. Clients seeking faster ramp-up and the ability to review posts in advance should consider the higher service levels, which allow for complete customization of content and posts. For packages costing $149 or less, all work is considered final, and no review is offered (unless advanced review and approval are added to the Pro or Cfreator plan). Typos or posts going out on the wrong date may occur due to edits altering the posting schedule. SocialNow.io provides an additional post based on the package level for such incidents, but no refunds are issued for typos or date discrepancies.
3.10. Blogs – Blog articles are typically 400-600 words in length and may vary. Once a first draft is delivered, a maximum of two revisions is allowed, after which the delivered content is considered final.
3.11. Video, Website Design/Landing Page, and Photography Work – Once the first draft of a website, photos, or video is created and delivered to the Client, no refunds are issued.
